Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your use of Spotguide — the mobile app, the web app at spotguide.app, and related services (together, the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
2. The Service
Spotguide helps you save restaurants you discover — from Instagram Reels and stories, TikTok videos, links, or search — onto your own map, with reminders when you’re nearby and tools to find the right saved spot later. You can also share lists of your spots, follow other people’s lists and profiles, and get recommendations matched to your taste. The Service is currently in beta: features may change, break, or be removed, and availability isn’t guaranteed.
3. Eligibility & your account
You must be at least 13 years old (or the minimum age required in your country) to use Spotguide. You’re responsible for your account and for keeping your sign-in method secure. Connect only Instagram accounts you own — content DM’d from a connected handle is saved to the account that verified that handle.
4. Content you send us
When you DM, share, or paste content (posts, Reels, stories, links, comments), you give us permission to process it — including with AI — to identify the places it features and to store what we learn (place names, dishes, descriptions) with your saves so search and the Guide assistant work. Only share content you’re allowed to share. The underlying posts belong to their creators and platforms; saving a spot stores our analysis and a reference, not the creator’s media.
5. AI features
Restaurant identification and the Guide assistant are powered by AI. AI makes mistakes: places can be misidentified, and details like hours, prices, addresses, or whether a business is still open can be wrong or out of date. Always double-check before you go. This applies equally when the Guide speaks its answers aloud in voice mode. AI answers are suggestions, not professional advice, and we’re not responsible for decisions made based on them.
6. Sponsored content
Some placements in the Service are paid promotions and are always labeled “Sponsored”. Sponsored placements are advertising; inclusion isn’t an endorsement of quality, and your experience at any business is between you and that business.
7. Public profiles & shared lists
Your profile card — username, photo, and bio — is public by default, and you can make it private at any time in your profile settings. Your lists and saved places stay private until you make a list public or share it by link. Anything you publish — your username, photo, bio, list names, and the places on shared lists — is visible to others, and you’re responsible for it. Don’t publish content that is offensive, deceptive, infringing, or that you don’t have the right to share. We screen public content automatically and with human review, and we may remove content, hide profiles, or suspend accounts that violate these rules. You can report any profile or list, and you can block any account — blocking means you and that account no longer see each other in the Service. Your private notes, tags, and ratings are never made public by sharing or following.
8. Acceptable use
Don’t misuse the Service. That includes: impersonating others or claiming Instagram handles you don’t own; sending spam, malware, or unlawful content; probing, scraping, or disrupting the Service or its APIs; circumventing rate limits or access controls; or using the Service to violate any platform’s terms or any law. We may suspend or terminate accounts (and block IP addresses) that do.
9. Third-party services
The Service relies on third parties — Meta (Instagram messaging), TikTok, Google (Places, Maps, Analytics, Play), Apple (App Store, TestFlight, notifications), and service providers for AI models, speech generation, cloud hosting, and app delivery. Their availability and terms are outside our control, and how they handle data is described in our Privacy Policy.
10. Ownership
Spotguide — the apps, design, code, and branding — is ours. We grant you a personal, non-exclusive, non-transferable license to use the apps for their intended purpose. Your saved lists, notes, and tags are yours; you can export nothing fancier than what the app shows today, but you can delete everything at any time (see Data Deletion).
11. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied — including fitness for a particular purpose, accuracy, and non-infringement. Restaurant information comes from third parties and AI analysis and may be wrong. Beta software will have bugs.
12. Limitation of liability
To the maximum extent permitted by law, Spotguide and its team won’t be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the greater of $50 or the amount you paid us in the twelve months before the claim (currently: the Service is free, so $50).
13. Termination
You can stop using Spotguide and delete your account at any time. We may suspend or terminate access for violations of these Terms, to protect the Service or its users, or if we discontinue the Service. Sections 10–14 survive termination.
14. Changes & governing law
We may update these Terms as the Service evolves; material changes will be reflected by the date above, and continued use after a change means you accept it. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
